Wages not paid on time: what the law says

In Israel wages are protected by law. A monthly salary must be paid by the 9th of the following month, and late payment entitles the worker to compensation. Below is what that means and how to act, step by step.

In short

When wages count as late
A monthly salary in Israel must be paid by the 9th of the month after the month worked (חוק הגנת השכר, the Wage Protection Law, §9–§10). If it has not been paid by that day, the law treats the wage as "withheld" (מולן), and from that moment the right to claim late-payment compensation (פיצויי הלנת שכר) from the employer arises. The right to claim the unpaid wage itself lasts up to 7 years, but the late-payment compensation has a far shorter deadline, as set out below.

How to act when your wages aren't paid

Work through it in order: first document the facts, then demand payment in writing, and only then approach the official channels.

  1. Document the facts and the amount

    Collect everything that proves the work and the amount: payslips (תלוש שכר), clock-in and clock-out records, messages and shift schedules. Note which month you are owed for, how much, and what the agreed payday was.

  2. Demand payment in writing

    Send the employer a written demand to pay the debt. It creates evidence and often settles the matter without court. State the amount, the period and the date by which you expect payment.

  3. File a complaint with the Ministry of Labor

    If the employer does not respond, you can file a complaint with the Ministry of Labor (משרד העבודה). A complaint and a labor-court claim are not mutually exclusive and you can pursue both.

  4. File a claim with the labor court

    Unpaid wages can be recovered through the regional labor court (בית הדין האזורי לעבודה). The procedure, the fee, the documents and the deadlines are covered in a separate guide linked below.
